CCTV & Video Surveillance Privacy Notice

Capital Estate Services Ltd uses CCTV and video surveillance in the common parts of Coldbath Square and Bakers Yard to help keep the estate safe, secure and well managed. About our CCTV systems

Capital Estate Services Ltd is responsible for managing and maintaining the common parts of Coldbath Square, Bakers Yard and associated estate areas.

To help provide a safe, secure and well-managed environment for occupiers, visitors and contractors, CCTV and video surveillance systems operate in parts of the estate.

CCTV signage is displayed at the principal entrances to monitored areas.


Where CCTV operates

CCTV may operate in the following areas, where appropriate:

  • Coldbath Square
  • Bakers Yard
  • Underground car park
  • Garden access and other shared external areas
  • Building entrances and shared internal areas
  • Video entry/intercom systems operated by Capital Estate Services Ltd

Not every location is monitored at all times, and camera coverage may change from time to time as part of the ongoing management of the estate.


Why we use CCTV

We use CCTV and video surveillance to help us:

  • protect people and property;
  • maintain the safety and security of the estate;
  • prevent, deter and detect crime, vandalism and anti-social behaviour;
  • investigate incidents, accidents, complaints and security breaches;
  • assist with the day-to-day management and operation of the estate;
  • protect the legitimate interests of occupiers, visitors, contractors and Capital Estate Services Ltd; and
  • assist the police, emergency services and other authorities where appropriate.


Our lawful basis

Under Article 6(1)(f) of the UK General Data Protection Regulation (UK GDPR), we process CCTV footage on the basis of our legitimate interests.

Our legitimate interests include maintaining a safe, secure and well-managed commercial estate and protecting people, property and assets.


What information we collect

Depending on the location and system, CCTV may record:

  • video images;
  • still images;
  • the date and time of recording; and
  • the location of the recording.

Certain video entry/intercom systems operated by Capital Estate Services Ltd may also record audio where this forms part of the normal operation of the system.

We do not use facial recognition technology or automated decision-making.


Who may access or receive CCTV footage

Access to CCTV footage is strictly limited to authorised personnel and will only take place where there is a legitimate operational, legal or security reason to do so.

Where appropriate, footage may be shared with:

  • the police or other law enforcement agencies;
  • emergency services;
  • insurers;
  • legal advisers;
  • professional investigators;
  • contractors responsible for maintaining our CCTV systems; and
  • other parties where disclosure is required or permitted by law.

We do not sell CCTV footage or use it for marketing purposes.


How long footage is retained

Routine CCTV recordings are normally retained for 30 days, after which they are automatically overwritten.

Where footage is required for the investigation of an incident, insurance claim, legal proceedings or another legitimate purpose, it may be retained for longer until the relevant matter has concluded.

Your rights

Under UK data protection law you may have the right to:

  • request access to your personal data;
  • request correction of inaccurate personal data;
  • object to processing in certain circumstances;
  • request restriction of processing where applicable; and
  • lodge a complaint with the Information Commissioner's Office (ICO).

Please note that requests involving CCTV footage may be limited where disclosure would adversely affect the rights and freedoms of other individuals.


Requesting CCTV footage

If you believe you have been captured by one of our CCTV systems and wish to make a request, please contact:

  • your name;
  • the date of the incident;
  • the approximate time;
  • the location; and
  • a brief description of the incident.

We may request proof of identity before disclosing any personal data.

Scope of this Privacy Notice

This Privacy Notice applies solely to CCTV and video surveillance systems operated by Capital Estate Services Ltd within the common parts of Coldbath Square, Bakers Yard and associated estate areas.

Individual occupiers, tenants and building owners may operate separate CCTV, video entry or access control systems within or serving their own premises. Where this is the case, those organisations are responsible for the operation of their own systems and for complying with their own obligations under UK data protection legislation.

If you have a query relating to a CCTV or video entry system operated by an individual occupier rather than Capital Estate Services Ltd, you should contact that occupier directly.
